Terms of Use

Effective October 26, 2026 · Version 2026-10-26

These Terms of Use (these “Terms”) govern access to and use of this application, including its websites, tools, reports, documents, assistant features, and related services (collectively, the “Service”). The Service is developed, owned, and operated by Restoration Automation LLC, a Wisconsin limited liability company (“Restoration Automation,” “we,” “us,” or “our”), and is made available to Kelmann and its personnel (“Kelmann” or the “Company”) under a separate written agreement between Restoration Automation and the Company (the “Agreement”).

Please read these Terms carefully. They contain important limitations on our liability, a disclaimer of warranties, a one-year limit on bringing claims, and a waiver of jury trials and class actions.

1. Acceptance of these Terms

By clicking to accept these Terms, by signing in, or by accessing or using any part of the Service, you (“you” or “User”) agree to be bound by these Terms and by our Privacy Notice, which is incorporated into these Terms by reference. If you do not agree, you may not use the Service. Continued use of the Service after any update to these Terms becomes effective constitutes acceptance of the updated Terms.

You represent that you are at least 18 years old, that you are an employee, contractor, or other person authorized by the Company to use the Service, and that you use the Service only on the Company’s behalf and within the scope of that authorization.

2. Relationship to the Agreement

These Terms govern each individual User’s use of the Service. The rights and obligations of Restoration Automation and the Company toward each other, including fees, ownership, data, confidentiality, and liability between the two companies, are governed by the Agreement. If these Terms conflict with the Agreement, the Agreement controls as between Restoration Automation and the Company. Nothing in these Terms gives any User rights under the Agreement.

3. The Service

The Service provides software tools that read, organize, compare, calculate, and summarize construction, restoration, and insurance-repair information, including estimate comparisons, supplement review findings, rough orders of magnitude, intake and job records, document drafts, and an artificial intelligence (“AI”) assistant. The Service may be changed, improved, suspended, or discontinued, in whole or in part, at any time, subject to the Agreement.

4. No Professional Advice

The Service is a software tool. It is notinsurance adjusting, public adjusting, appraisal, claims handling, legal advice, insurance advice, accounting or tax advice, or architectural or engineering advice, and Restoration Automation is not a public adjuster, insurer, appraiser, law firm, or licensed design professional. The Service does not determine what any insurance policy covers or owes, does not advocate for any party, and does not communicate with insurers, adjusters, customers, or anyone else on your or the Company’s behalf. You are solely responsible for complying with all laws that apply to your own activities, including insurance, public-adjusting, licensing, consumer-protection, and contractor laws.

5. AI Outputs; Verification; No Reliance

The Service uses automated parsing and AI, including large language models provided by third parties, to produce reports, comparisons, totals, matches, findings, summaries, calculations, drafts, answers, and other results (“Outputs”). You acknowledge and agree that:

  • Outputs are generated by software, may be inaccurate, incomplete, inconsistent, or out of date, and may contain errors, omissions, misreadings, mismatched items, and incorrect calculations;
  • the same inputs may produce different Outputs at different times;
  • Outputs are informational starting points for review by a qualified person, and are not statements of fact, findings, opinions, certifications, or guarantees by Restoration Automation;
  • before relying on any Output in a claim, supplement, estimate, bid, invoice, negotiation, contract, dispute, or other business or legal decision, you will independently verify it against the source documents, actual site conditions, and applicable standards; and
  • any decision to use, rely on, share, or act on an Output is made solely by you and the Company, at your and the Company’s own risk.

You will not present any Output to an insurer, adjuster, customer, court, tribunal, or other third party as a verified finding, as the work or opinion of Restoration Automation, or as the work of a licensed professional. If you share an Output, you are responsible for reviewing it first and for any statement you make about it. To the fullest extent permitted by law, you waive and release any claim against Restoration Automation arising from reliance on an Output that was not independently verified as described above.

6. The AI Assistant

The assistant is software, not a person. Its answers may be wrong, incomplete, or inconsistent, and must be checked against the related report and source documents. Your questions, the related data, and the answers are transmitted to our AI provider to generate responses and are stored to operate, secure, support, and improve the Service for the Company. Do not submit information to the assistant that you are not authorized to share. You will be asked to acknowledge these points before your first use of the assistant.

7. Estimates, ROMs, and Customer-Facing Documents

Rough orders of magnitude, equipment recommendations, pricing figures, and similar Outputs are planning estimates only. They are not bids, quotes, final estimates, or offers. Before any such figure is shared with, presented to, or signed by a customer, carrier, or other third party, you will verify measurements and conditions on site and reconcile pricing against the Company’s own estimating systems and pricing.

The content of authorizations, consents, work orders, contracts, estimates, and other documents presented to or signed by the Company’s customers (“Customer Documents”) is the Company’s. The Company, not Restoration Automation, is responsible for the wording, accuracy, legality, and enforceability of Customer Documents, for obtaining any required consents and disclosures, and for its relationships and obligations with its customers. Restoration Automation is not a party to any Customer Document.

8. Your Responsibilities and Acceptable Use

You agree that you will:

  • keep your sign-in credentials confidential, not share your account, and promptly report any suspected unauthorized access to the Company and to us;
  • upload, enter, or submit only information that you and the Company have the right to use and that does not violate any law or anyone’s rights;
  • use the Service only for the Company’s internal business purposes and in compliance with all applicable laws; and
  • review and confirm the accuracy of information you enter, including job details, quantities, rates, and labels.

You will not, and will not attempt to:

  • access data or accounts you are not authorized to access, or bypass or interfere with security, authentication, permissions, or usage limits;
  • copy, modify, reverse engineer, decompile, scrape, or create derivative works of the Service, or use it or its Outputs to build or train a competing product, model, or dataset;
  • probe, scan, overload, or disrupt the Service, or introduce malicious code;
  • use the Service to commit or facilitate fraud, including insurance fraud, or to misrepresent any fact to an insurer, customer, or other party; or
  • remove or obscure any notice, disclaimer, or proprietary marking in the Service or its Outputs.

9. Data, Content, and Feedback

As between Restoration Automation and the Company, the Company owns the documents and data uploaded to or generated for it in the Service (“Company Data”), as provided in the Agreement. You grant Restoration Automation and its service providers the right to host, copy, process, transmit, display, and analyze Company Data as necessary to provide, operate, secure, support, and improve the Service for the Company, and as otherwise permitted by the Agreement. We may collect and use technical and usage information about the operation of the Service (such as performance, errors, feature use, and processing costs) to operate, secure, and improve the Service.

If you provide suggestions, ideas, or other feedback about the Service, Restoration Automation may use it without restriction or compensation, and without any obligation to you.

10. Intellectual Property

The Service, including its software, source code, architecture, workflows, prompts, models, algorithms, review rules, designs, report formats, documentation, and all improvements to them, is owned by Restoration Automation and its licensors and is protected by copyright, trade secret, and other laws. Except for the right to use the Service as described in these Terms and the Agreement, no rights are granted to you, by implication or otherwise. All rights not expressly granted are reserved.

Xactimate® is a registered trademark of Xactware Solutions, Inc. Other product and company names are trademarks of their respective owners and are used only to describe file compatibility. Restoration Automation is not affiliated with or endorsed by them or by any insurance carrier.

11. Third-Party Services

The Service relies on third-party providers for hosting, databases, storage, authentication, workflow automation, email, and AI processing. Their services are outside our control and are subject to their own terms. We are not responsible for any outage, error, change, or act or omission of a third-party provider, except as expressly provided in the Agreement.

12. Electronic Acceptance, Signatures, and Records

You agree that these Terms, the acknowledgments you confirm in the Service (including before running a comparison, sharing or printing a rough order of magnitude, uploading intake files, and using the assistant), and any other click-through acceptance are electronic records and signatures under the federal Electronic Signatures in Global and National Commerce Act and the Wisconsin Uniform Electronic Transactions Act, and have the same legal effect as a handwritten signature on a paper agreement. We keep records of each acceptance, including the exact wording accepted, its version, the date and time, your account, and your IP address and browser information, and those records may be used as evidence of your agreement.

13. Suspension and Termination

Your access ends when the Company removes your account or its access to the Service ends. We may suspend or restrict your access at any time, with or without notice, if we reasonably believe you have violated these Terms, your account is compromised, or suspension is needed to protect the Service, the Company, or others. Sections 4 through 7, 9 through 12, and 14 through 19 survive any termination.

14. Disclaimer of Warranties

To the maximum extent permitted by law, and except as expressly provided in the Agreement, the Service and all Outputs are provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, or statutory, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, availability, or that the Service will be uninterrupted, secure, or error-free, or that any error will be corrected.

15. Limitation of Liability

To the maximum extent permitted by law, Restoration Automation and its members, managers, employees, contractors, and suppliers will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, or goodwill, or for any claim, supplement, payment, denial, settlement, or business decision made in reliance on an Output, however caused and under any theory of liability, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability to you for all claims arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars (US$100). Liability between Restoration Automation and the Company is governed exclusively by the Agreement.

16. Your Responsibility for Misuse

To the extent permitted by law, you are responsible for, and will hold Restoration Automation harmless from, claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or applicable law, your unauthorized use of the Service, or your misrepresentation of an Output to any third party. Nothing in this section limits the Company’s obligations under the Agreement.

17. Disputes

Informal resolution

Before filing any claim, you agree to contact us at support@restoration-automation.com and try in good faith to resolve the dispute informally for at least thirty (30) days.

Time limit

To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be brought within one (1) year after the claim arose, or it is permanently barred.

Governing law and venue

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. Any action arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.

Jury trial and class action waiver

To the extent permitted by law, you and Restoration Automation each waive any right to a jury trial, and any claim must be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

18. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the effective date and version above and ask you to accept the updated Terms in the Service before you continue. Changes do not apply retroactively to disputes that arose before the change.

19. General

These Terms, the Privacy Notice, and the acknowledgments you accept in the Service are the entire agreement between you and Restoration Automation about your use of the Service. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of our business or assets. Headings are for convenience only. Notices to you may be given through the Service or by email to the address on your account.
